By accessing the website www.eriri-editions.com you agree to these terms and conditions of use. Please carefully read these terms. By accessing the website you warrant and represent to the Website owner that you are legally entitled to do so, including that you are over 18 years old or have reached full legal age in the country from where you are accessing the website.

If you do not agree to be bound by these terms and conditions you may not use or access this website.

We may change these Conditions at any time without notice. The latest version of these Conditions is available on our Website. The www.eriri-editions.com website is provided solely for your personal use. You may not use this website for any commercial purpose.

The applicable version of these GTCS is always the one displayed on the website at the time of the pre-order or order.


1 - Object

These are the terms and conditions of sale ("Conditions") of ERIRI (the company, we, us). These conditions will apply to all purchases of goods via our website www.eriri-editions.com (the "Website"), under the condition that you (the customer submitting an order for goods with no commercial purpose) live in the country from where you are accessing the website when you order via the website; and to all deliveries related to said purchase(s) to the customer or to any third party (named by the customer) residing in the same country with same legal entitlement as the customer. These terms shall apply to all purchases of goods ordered via the website and the customer confirms unconditional acceptance of these conditions when confirming an order on the website.
We may change these conditions at any time without notice. The latest version of these conditions is available on our Website. Conditions applying are those in effect on the day of the purchase(s).

 

2 - Company


The Website eriri-editions.com is an e-commerce website that is accessible on the Internet at the address www.eriri-editions.com and it is open to any user of the Internet. It is edited and distributed by the micro-entreprise ERIRI, represented by Madame Florence FRANKS. Its head office's address is 9 RUE GUSTAVE FLAUBERT 75017 Paris, France. It is registered in the Paris Trade and Companies Register under the number 879717510.

The Website offers to sell a variety of clothes and accessories for women in linen fabric to users browsing on the Website. By virtue of these Terms of sale, it is agreed that the User and ERIRI will be collectively named "the parties" and individually called the "party", and that the User who validated an order will then be called the "Buyer". The rights and duties of the User inevitably apply to the Buyer.

ERIRI reminds that the Products are exclusively for the personal use of the Buyer and it must not have any direct link with his professional activity. ERIRI reserves the right to refuse the carrying out of the order.

The Buyer declares that he has full legal capacity.

The order of any Product offered on the Website presupposes the consultation and the express consent of these General Terms and Conditions by ticking the box provided to that effect before ordering anything.

In order to place an order, you have the choice to create or not a customer account on ERIRI website, that will gather and keep your information for future orders. 

These GTCS apply in their entirety regardless of the choice you make. 

As a reminder, according to the provisions laid down in the articles 1316 to 1316-4 of the Civil Code, supplemented by the Decree n° 2001-272 of 30 March 2001, for the application of the article 1316-4 of the Civil Code and concerning the e-signature, Rouje specifies that the validation of the order form as specified in the article 5.3 hereafter, constitutes an e-signature that has, between the Parties, the same value as a handwritten signature.

The aim of the General Terms and Conditions is to define the rights and duties of the Parties born from the online sale of the Products offered on the Website.

3 - Products and Disclaimer of Liability

3.1 - Every care has been taken to ensure that the photographic representation, description and specification of each product are accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual sold items. The Company shall not be responsible for such discrepancies. ERIRI only has a best effort obligation and shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In particular, neither the Company nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof, nor in case of force majeure as defined by Law.

3.2 - ERIRI reserves the right at any time to change or discontinue without notice, any aspect or feature of this website and Conditions. All provisions of any relevant terms and conditions, policies and notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. We may change these Terms and Conditions at any time. If any of these terms and conditions is invalid or unenforceable, the remainder of these terms and conditions shall continue to have full force and effect.

3.3 - The products sold via a Pre-Order system, are only offered within the limit of the announced pre-order period (hereinafter "Pre-order"). Each pre-order campaign generates information, relating to the duration of this campaign. 

Products remaining in stock after delivery and potential returns of pre-ordered products are only offered within the limits of available stocks (hereinafter "Order of products in stock"). 

4 - Pre-Orders and Orders

4.1 - The placing of a pre-order is subject to compliance with the procedure set up by ERIRI, which includes successive stages leading to its validation (selection of the articles, viewing of your basket, choice and methods of delivery, validation and confirmation of your order, payment).

Before proceeding with this validation, you must read and accept without reservation these Terms and Conditions of Sale. In accordance with article L.221-13 of the Consumer Code, you will then receive by electronic means, which you accept, a summary confirmation of your pre-order. Invoices are available from your customer account and are, in any case, provided upon delivery. 

If the minimum objective of the pre-order campaign is not reached at the time of its closure, ERIRI will proceed to the cancellation of your pre-order and the reimbursement of its full amount, including shipping costs, within a maximum period of fourteen (14) working days.

4.2 - The placing of an order for products in stock is subject to compliance with the procedure set up by ERIRI, which includes successive stages leading to its validation (selection of articles, viewing your basket, choice and methods of delivery, validation and confirmation of your order, payment). Before proceeding, you must read and accept without reservation these Terms and Conditions of Sale. In accordance with article L.221-13 of the Consumer Code, you will then receive by electronic means, which you accept, a summary confirmation of your order. Invoices are available from your customer account and are, in any case, provided with the summary confirmation of your order.

4.3 - Orders may only be placed by legally authorized Customers aged 18 and over, holding a personal bank credit card (Visa, MasterCard, Amex, Apple Pay) or by a Paypal account. All orders are subject to availabilities. Customers have access to stock availabilities and product descriptions on the Website. Should one product be out of stock, the Company will rapidly advise Customers by email and will issue a refund of the exact corresponding price to the original card that was used for the purchase or may suggest to the Customer to amend placed order according to stock availabilities.

The Company reserves the right to refuse your order request should your payment records be unsatisfactory. Failure to meet the eligibility to order criteria set out in the Terms and Conditions may occur. In this case, the Company may advise you by phone or email within six (6) days after you placed your order. The absence of action or inappropriate action shall result in the pure and simple cancellation of your order.

ERIRI reserves the right to remove at any time any product displayed on the Website and also the right to modify any content or information related to any product. 

5 - Use of your information

When you place orders on our Website, we collect certain personal and transactional information (i.e. name, address, email address, phone number and credit card details) from you so that we can process, fraud check and deliver your order. Details of your address and also the telephone number and email you have provided us will be shared with our courier partner; these details have been shared to assist in providing you with delivery service and will not be used by this third party for any other reasons. These details allow us to process your order and to let you know the status of your order. In accordance with Law of 6th January 1978 regarding Information Technology and Privacy, amended 6th August 2004 (French Law), all customers may alter, oppose and have access to their personal information. If you wish to do so, please send the Company an email with your name, surname, email address and postal address to: hello@eriri-editions.com

The confirmation of an order, orders and invoices are registered on the records of ERIRI, which are stored on a reliable and sustainable support. The Customer accepts that the confirmation of an order is considered to be proof of the contractual relationship between the Parties. 

The computerized record stored by ERIRI will be accepted by the parties to be proof of the communications, orders, payments and transactions occurring between them.

 

6 - Online orders on our Website

The customer shall carefully follow the instructions on the Website when placing orders to ensure proper processing.

7 - Order Acceptance

Emails and Website records are proof (order acceptance, payment, order date and content) between you and the Company.

8 - Price

Unless otherwise stated, all prices on the Website are in Euro (EUR), including VAT (all taxes included). VAT is applied at the rate in force in Metropolitan France at the time of the order. 

The Prices of the Products are given without the participation to the delivery costs, on the day of the order.

The price billed to the Buyer is the price given on the order confirmation that ERIRI sent by email.

ERIRI reserves the right to update the prices at any time without notice. The Products will be billed on the basis of the rates in force when the order is entered, within the limits of available stocks. The rate in force is the one given on the Website, errors of typography excepted, for which ERIRI is not responsible.

Prices are payable in full in a single installment when the order is confirmed.

Any missed payment will result in the invoicing of a 25 Euro fee for each payment incident. The data recorded by the Website are a proof of the transactions between ERIRI and the Buyer. The data recorded by the payment system are the proof of financial transactions. The sale is final when the secure services accept the transaction.

 

9 - Payment

9.1 - It is stated that you can pay on the Website by bank cards or by an Paypal account. The payment for the Products bought on the Website can be done safely, from France or from foreign countries, 24/7, with the following payment methods : Visa, Mastercard, Amex, Apple Pay, Paypal. The User will enter his card number, the cardholder name, the term of validity and the 3 numbers of the visual cryptogram that is on the back of your card.

ERIRI reserves the right to refuse to honour the order of a User if ERIRI and the User are under dispute, of any nature whatsoever.

9.2 - ERIRI uses the secure payment system STRIPE. The integrity of the data exchanged between the Buyer and the secure platform STRIPE is protected against any hacking attempt. The confidential data are directly transmitted on the server of the bank, without ever being sent through the servers of ERIRI.

STRIPE leans on the encrypted exchange protocol SSL (Secure Socket Layer) and provides all insurance required for transactions on the Internet.

ERIRI reserves the right to cancel any order presenting a risk of fraudulent use of the bank card.


10 - Delivery

10.1 - Delivery of pre-ordered items:

ERIRI offers pre-order garments and accessories. The manufacturing of these items only starts once the pre-order period is over, and provided that the minimum manufacturing quantities have been reached. The time between your pre-order and the delivery varies according to the type of product sold and to its manufacturing requirements. You will be informed on a regular basis of the manufacturing stages and the progress of your order. As soon as the pre-order period is closed and after checking manufacturing times with our suppliers and manufacturers, you will be informed of the firm delivery time of your ERIRI item. In any event, the maximum delivery time for pre-ordered products will be six (6) months from the closure of the pre-order campaign. In the event of an order for products in stock, they will be delivered within four (4) weeks from the date the order is placed on our website.

10.2 - The Products ordered are, depending on the choice of the Buyer, delivered to any address in the following countries:  Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, The Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Metropolitan France, Monaco, The Netherlands, Poland, Portugal, Romania, Saint-Marin, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, Vatican City

The address of the delivery is given by the Buyer.

The orders are dispatched, depending on the choice of the Buyer, by the postal service Colissimo.

The Buyer will be able to track his order on the Internet. ERIRI is committed to do its very best so that the order is carried out within a maximum of 4 weeks starting on the date of confirmation of the order, except for Products sold “on Pre-Order” and except in cases of force majeure given in article 18. 

The products ordered by the Buyer will be delivered to the address given by the Buyer on the order form or they will be left at the Post office attached to the delivery address of the Buyer.

In case of absence or impossibility of delivery of the parcel, Colissimo will leave you a delivery notice mentioning the address of the post office where you can collect it upon presenting of identity document, and the date on which it will be available there.

The delivery address cannot be a PO Box. The information submitted by the Buyer is part of the sales contract. In case of error in the delivery information given by the Buyer, ERIRI could not be held responsible for failure in delivery.

10.3 - The shipping costs are based on the destination and weight of the parcel, according to the rates of the postal services in effect. The shipping prices are fixed according to a flat rate according to the place of destination: Metropolitan France or Europe. If the forwarding is imputable to you (the delivery address you gave was not correct, or you did not get the parcel at the post office within the 15 days), there will be additional charges, upon acceptance of the Buyer. If the Buyer does not accept to pay these additional charges, the order will be cancelled and the Buyer will be refunded the amount of the order on his bank account, minus the delivery charges.

For shipments outside France including DOM: "the customer will support the local taxation of the country of consumption."

10.4 - Standard delivery in Metropolitan France:

For deliveries in Metropolitan France shipping is handled by Colissimo. The shipping cost for Metropolitan France is 5 Euros for orders under 150 Euros.

In case of non-delivery your parcel will be returned to our warehouse.

We will contact you by email to give you the reasons for non-delivery. We may ask you to confirm delivery address and plan a new date for dispatching the Products. In case of non-delivery due to invalid information provided by the Buyer (including, without limitation, address not valid, wrong postal code, no door code provided, staircase number or name not provided, wrong name on site), the delivery will be delayed. The Company shall not be responsible for such inconvenience.

10.5 - Deliveries outside Metropolitan France:

All ordered items from the European Union are shipped with Colissimo.

The shipping cost for Europe is 12 Euros and 15 Euros for United Kingdom for orders under 150 Euros.

At the moment we DO NOT ship outside of Europe.

10.6 - Colissimo will then deliver your order from 48h to 10 days depending on the country.

Delivery timelines may vary according to your order availability (please note that specific timeline apply for Products sold on Pre-Order).

Delivery timelines are processed on business days and correspond to the average order preparation and shipping schedule on the territory.

Delivery timelines start from the order confirmation date by the Seller (please note that specific timeline apply for Products sold on Pre-Order).

We put the ordered items to delivery process within 48 hours after receiving your order (working days only which except Saturday, Sunday, and public holidays) for products in stock only.

Euro Zone (except France): Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, The Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, The Netherlands, Poland, Portugal, Romania, Saint-Marin, Slovakia, Slovenia, Spain, Sweden, Switzerland, Vatican City.

Public Holidays (Customer service and Dispatching are closed):

The Buyer has to provide a valid telephone number and detailed address with floor, building name or number and door code if need be. One sole carrier is in charge of the delivery. 

10.7 - Do not accept a damaged parcel (parcel that has been visibly open or damaged). Parcels are faultless when leaving ERIRI warehouse and should be in the same state when delivered to the Buyer. Should you receive a damaged parcel in your mail box or should your keeper sign for a damaged parcel without inspection nor notification then the parcel is considered valid and accepted and we would not consider the damage or potential loss and therefore would not accept any refund claim a posteriori.

Whilst every effort is made to accurately and efficiently process your order, products may be missing in your delivery. Also, due to the transportation, a product may be delivered faulty. That is why we recommend that you inspect the Products in the parcel at the time of the delivery. In case of faulty delivery (missing item, faulty item, damaged parcel), advise by recorded mail our Customer Service on the day of delivery or at the latest, on the following working day (to concierge@eriri-editions.com). Any later claims shall be lawfully refused by ERIRI who shall not be liable for the damage. ERIRI reserves the right to request the return of faulty items to their warehouse. Should the aforementioned conditions be fulfilled, ERIRI will edit a credit note for the refund of the faulty item(s) or organize the delivery of the missing item(s) for legitimate claims.

11 - Cancellations and Returns Policy

11.1 -  Standard Returns Policy:

Subject to the European Parliament and Council Directive regulating Consumers rights, the Buyer has fourteen (14) clear days from the day following receipt of your ERIRI item to exercise his right of withdrawal without giving a reason or incurring a penalty. Within fourteen (14) days the Buyer can return the delivered Products in their original packaging, complete with all tags, labels, potential gifts and any related accessories or instruction booklets.

Before you send back your order, we request an email at concierge@eriri-editions.com  with your name and the number of your purchase. 

You must return your product no later than fourteen (14) days after sending your withdrawal using the return slip provided by ERIRI (pre-paid return mailing label will be provided by ERIRI for free, only within Metropolitan France). 

The cost of returning are at the expense of the Buyer outside Metropolitan France

A refund (excluding the initial shipping costs and the return delivery charges) will be issued to the means of payment used for the purchase, within fourteen (14) working days following the delivery of your return parcel in our warehouse or upon receipt of its delivery proof.

Damaged articles, not in the same condition as when sent originally as well as worn and washed items, will not be reimbursed.

For any claim, we kindly ask the Buyer to write by email at: concierge@eriri-editions.com  

If the Product is found leading to non-compliance with the order, or is defective upon delivery, or if the product is defective, the return shipping fees will be the responsibility of ERIRI. In this case, ERIRI will provide you a prepaid return mailing label that you can use to return your shipment. Please contact the customer service at  concierge@eriri-editions.com to get it within three (3) days.

ERIRI does not accepts the postage due parcels. In accordance with the article L216-4 of the Consumption code, the return label without transporter, any risk associated with the transport is carried by the Buyer. The Buyer is not responsible if the parcel is lost.

It is the Buyer’s responsibility to obtain proof that the goods have been returned, by returning the items by registered post or by such other tracked means which gives proof of date of postage and delivery. 

The initial delivery costs are not refunded, however we bear the return costs (in Metropolitan France only).

 

12 - Exchanges

Please note we do not accept item / color / size exchanges at the moment.

In case of faulty item(s) only, exchanges will be possible within the limits of available stocks.

In the instance that the Products cannot be exchanged, a refund will be issued by the Company to the original card that was used for the purchase within fourteen (14) days of receipt of the return in our warehouse, such refund will include the initial shipping costs if the complete order is faulty.

Notwithstanding the specific warranties delivered to the Customer for a specific delivered product, the Goods sold buy the Company comply with legal warranties of European Parliament and Council Directive 1999/44/EC.

 

13 - Intellectual Property Rights

The Website remains the exclusive property of the Company ERIRI. This website and its content including all text, graphics, logos, button icons, images, videos and sounds, data compilations and software used in connection with this website, is our property or that of our suppliers and is protected copyright, trademarks, database rights and other intellectual property rights. Any attempt to access the Website source code and protocols or any reproduction, whether complete or partial, modification or use of these marks, illustrations, images and logos, for whatever reason and in whatever medium, without our written, express and prior agreement, is strictly prohibited.

Any copying, reproduction or fraudulent use through any means is considered as counterfeiting and the counterfeiter’s civil and/or criminal liability may be held. ERIRI reserves the right to claim for compensation for the recognized prejudice.

You hereby acknowledge that ERIRI Website (www.eriri-editions.com) and its content are protected copyright, trademarks, patents rights, database rights and other lawful intellectual property rights.

The “ERIRI” name is subject to a trademark registration at the INPI. In consequence, all reproductions of this brand, non authorized by ERIRI constitute a counterfeit act that can be the object of penal or criminal prosecutions.

The web User is thus forbidden to harm the “ERIRI” brand. It is strictly forbidden to use or reproduce the ERIRI name for any reason, on any medium without the prior and written authorization of ERIRI.

 

14 - Commercial communication and newsletter

ERIRI is likely to send Buyers commercial offers by mail, email, or via all the web spaces run by ERIRI on social networks, subject to prior acceptance.

The Buyer has the option at any time to object free of charge to his commercial prospecting mailings, by clicking on the "unsubscribe" link in each email.

15 -  Partial non validity

If a particular stipulation of these General Terms and Conditions of Sale is held invalid or declared as such by any Authority of res judicata of competent jurisdiction, the remaining provisions will remain in full force and effect.

16 - The entire contract

These General Terms and Conditions of Sale and the order summary transmitted to the Buyer form a single contract and constitute the whole of the contractual relationship between the Parties. In case of contradiction between the documents, the General Terms and Conditions of Sale have priority.

17 - Guarantee

All products are covered by the legal guarantee of conformity (French Consumer Code) and the guarantee against hidden defects (French Civil Code). These guarantees will only apply if the buyers reacts during a period of 2 (two) years after the delivery date (guarantee of conformity) or after discovering the hidden defects (guarantee against hidden defects).

Within the framework of the guarantee against hidden defects, the Buyer is informed that in application of articles 1642 and the following ones of the same code :

- The action resulting from latent defects shall be capped to two years from the discovery of the defect;

- ERIRI is not bound by apparent defects which the buyer has been able to convince himself of;

- ERIRI is liable for hidden defects of which it could legitimately have been aware at the time of the sale;

- After assessment of the defect, the Buyer has the choice to return the item and have the money refunded, or keep the item and have part of the price refunded. 

Excluded from the warranty against hidden defects are products that were modified, repaired, integrated or added by the Buyer or due to improper use by the Buyer. 

 

18 - Liability – Force Majeure

ERIRI has only a mere best efforts obligation for every step to access and order on the Website (order process, delivery, customer service, etc.).

ERIRI cannot be held liable for any harm inherent in using the Internet, such as a breach in service, outside intrusion or the presence of a computer virus, or for any event deemed to fall under force majeure, in accordance with the case-law, in particular a strike of the postal services, a stock out from the manufacturer, the destruction or the total loss of the stock, as well as any exceptional event.

 

19 - Applicable Laws

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of the French Republic without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of France in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
